General terms and conditions

Article 1: Definitions

  • 1.1 In these general terms and conditions the following terms shall have the following meanings: Tramhuis Foundation: the foundation that organizes and carries out (historical or cultural) tours, programs or activities.
  • Participant: any person who takes part in an activity of the Tramhuis Foundation.
  • Booker: the person who places a booking and/or makes the payment, and thereby enters into an agreement with Stichting Tramhuis.
  • Agreement: the agreement between the Booker and Stichting Tramhuis whereby participants take part in an activity organised by Stichting Tramhuis.
  • Activity / Tour: a guided tour, program or event that is carried out by Stichting Tramhuis, with or without the involvement of third parties.
  • 1.2 These general terms and conditions apply to all activities, bookings and transactions of Stichting Tramhuis and form an integral part of every agreement.

Article 2: Conclusion of the Agreement

  • 2.1 A booking is concluded when Stichting Tramhuis confirms the request in writing (by e-mail or online system), or as soon as payment has been completed by the Booker.
  • 2.2 When entering into the Agreement, the Booker declares that he/she agrees to these general terms and conditions.
  • 2.3 All prices stated are inclusive of VAT, unless otherwise stated.

Article 3: Execution of the Activity

  • 3.1 Stichting Tramhuis strives for a correct execution of the tour as described on the website and the app.
  • 3.2 Stichting Tramhuis reserves the right to change the content, location or time of a tour in case of force majeure, unforeseen circumstances or insufficient participation. In that case, the Booker will be informed in a timely manner.
  • 3.3 If a Participant is not present on time (at least 5 minutes before the start), the tour may be shortened or modified, without the right to a refund.
  • 3.4 Participation in activities is at your own risk. Stichting Tramhuis is not liable for injury or damage, unless there is intent or gross negligence.

Article 4: Liability and conduct

  • 4.1 Participants must behave respectfully and follow the instructions of the guide or organization.
  • 4.2 In the event of misconduct or causing a nuisance, Stichting Tramhuis reserves the right to refuse further participation.
  • 4.3 Any damage caused by a Participant will be recovered from the Booker.

Article 5: Cancellation and changes

  • 5.1 Cancellation by the Booker must be made in writing.
  • 5.2 In case of cancellation up to 7 days before the start of the activity, the Booker will receive the full amount back. In case of cancellation between 7 and 2 days before the start, 50% of the amount will be refunded. Within 48 hours before the start, no refund is possible.
  • 5.3 If Stichting Tramhuis cancels an activity, the Booker will receive the full amount paid back. Further compensation is excluded.

Article 6: Payment

  • 6.1 The Booker is obliged to pay the full amount before the start of the tour.
  • 6.2 If payment is not made, Stichting Tramhuis reserves the right to cancel the tour or refuse participation.

Article 7: Complaints

  • 7.1 Complaints about the execution of the tour must be submitted in writing no later than 7 days after completion.
  • 7.2 Filing a complaint does not suspend the payment obligation.

Article 8: Privacy

  • 8.1 Stichting Tramhuis processes personal data in accordance with its privacy statement, which can be found on the website and app of Stichting Tramhuis.

Article 9: Applicable law

  • 9.1 These terms and conditions and the Agreement are exclusively governed by Dutch law.
  • 9.2 Disputes will be submitted exclusively to the competent court in the district in which Stichting Tramhuis is established.
